What is housing disrepair?

Housing disrepair is when a property becomes unsatisfactory and unfit for habitation due to disrepair. Disrepair is when a property suffers from damp and mould growth on walls, floors and ceilings.

Other disrepair issues in a property include broken or faulty boiler, faulty wiring, defective doors and windows, internal issues to wallpaper, carpets and paint. Leaks and water damages from roof, bathroom, pipes and windows can also be classed as disrepair.

The landlord has a legal obligation to maintain a property and ensure that the property remains in a good state. The landlord will need to ensure that the occupant is provided with safe and comfortable living conditions.

If a tenant has notified the landlord in respect of disrepair within the property and the repairs have not been undertaken within a reasonable time frame, then a tenant has recourse to compensation.
